Have you considered hiring a support staff to help better manage your workload? Before you do, it’s important that you first determine whether or not your practice can sustain an additional employee and second, make preparations to hire the right applicant.

The IRS is encouraging business taxpayers, associations, and other interested parties to submit tax issues for resolution involving a controversy, a dispute, or an unnecessary burden on business taxpayers to the Industry Issue Resolution (IIR) program.

The objective of the IIR program is to resolve business tax issues common to significant numbers of taxpayers through new and improved guidance. In past years, issues have been submitted by associations and others representing both small and large business taxpayers, resulting in tax guidance that helps thousands of taxpayers.

Requests for guidance on tax issues under the IIR program can be submitted by e-mail at any time to IIR@irs.gov. Submissions received are reviewed semi-annually with selections next being made from issues submitted by September 30, 2010.

As we shared with you earlier this month, the IRS announced it will eliminate the debt indicator for refund anticipation loan lenders. The debt indicator is an essential underwriting tool that banks use when considering whether to loan money to clients.

We strongly believe these consumers should have year-round, real-time access to their credit information to assist them in all their financial decision-making – including obtaining affordable financial products.

Kate Fulton, SVP-Government Relations, and her team are reaching out to influencers and working with our communications team to get our messaging out publicly against this action.  We also are working with our industry counterparts to address this issue head on.

How you can make a difference:

There is something each of you can do to help our valued clients and improve their choices for credit.  We have drafted a letter aimed at legislators to help educate them on this issue and to ask for their support to reinstate the debt indicator so that we can continue offering products and services taxpayers want at affordable prices.

We have automated the process to make it easy for you to voice your concern.  By following the simple steps outlined below, your letter will automatically be sent to your elected officials.  Here is all you have to do:

  1. Log into the myBlock Company Login at https://myblock.hrblock.com/pps/guest/Login
  2. Select the myCompany tab then click the Government Relations link
  3. Click on the “Take Action” Button located on the homepage of the Government Relations site
  4. Click on your respective letter based on your role.
  5. Type in your name and address where indicated so that it will automatically locate your congressman.
  6. The letter will automatically go to your congressmen and senators to weigh in on this issue as a constituent and a voter.

The IRS has updated its frequently asked questions (FAQs) regarding the automatic revocation of tax exempt status for failure to file for three consecutive years. The IRS revised the fifth question in the FAQs to add a list of IRS guidance to help small organizations come back into compliance and it removed language from the original versions of the sixth and seventh questions.

The revised FAQs are on the IRS website.

This issue is a big one for all of our communities throughout the United States.  Members need to reach out to organizations on the “at risk” list in their communities to make them aware and provide help.

A recent Kiplinger report (August 20, 2010) offered the following updates on the Preparer Registration Rules.

“More details are dribbling out on IRS’ upcoming regulation of tax preparers.  Starting with 2010 returns, all paid preparers will have to register with the IRS and pay a fee of $64.25 to get a preparer ID number to enter on returns.  In addition, un-enrolled return prepares. . . those other than lawyers, CPAs and enrolled agents. . . will have to pass competency tests and satisfy continuing education requirements.

“Testing will begin in mid-2011.  Those who register and get an ID number before the testing regime is up and running will have until the end of 2013 to pass.  In the interim, they can still validly prepare tax returns for 2010, 2011 and 2012.  They can take the test multiple times, but they will have to pay a fee each time.  A third party will give the tests at various locations.  They won’t be available online.  Commercial firms are expected to offer test preparation courses.  IRS won’t do so.”  The Kiplinger Tax Letter, Vol 85. According to the IRS, hundreds of thousands of non-profit organizations have failed to file their required returns, and are in grave danger of losing their exempt status. NATP urges members to download the IRS at-risk list for their state and search for organizations in their local communities that are at-risk of losing tax-exempt status on October 15, 2010. For example, the list for Wisconsin includes over 6,000 organizations. The Illinois list includes almost 15,000, and the California list includes over 35,000. The full list for each state is available on the IRS website.

As a public service, contact your local organizations to make them aware of the special IRS relief program which may preserve the organization’s exempt status. Failure to act now may result in the loss of exempt status on October 15, 2010. If an organization loses its exempt status, donor contributions are no longer tax deductible, and the organization may be required to file Form 1120 or Form 1041, and pay income tax.

Let’s do our part to help make sure the not-for-profit organizations in our communities do not lose their exempt status. Many of these organizations, with their operations dependent on volunteers, may not be aware of these filing requirements, or the dire consequences of failure to meet them.

The IRS has issued proposed regulations eliminating the rules for making federal tax deposits by paper coupon. The paper coupon system will no longer be maintained by the Treasury Department after December 31, 2010. The regulations are consistent with a Financial Management Service initiative announced in April to increase the use of electronic transactions between taxpayers and the federal government.

The proposed regulations, REG 153340-09, generally maintain existing rules for depositing federal taxes through the Electronic Federal Tax Payment System (EFTPS).
